At a sitting of Tullamore District Court, the Court confirmed the ex parte interim order granted on the 28th October. The Court also dismissed the appeals by the provider against the notices of decision to cancel and refuse registration made by the Chief Inspector.

The Authority acknowledges the decision of the Court granting the Orders sought by the Authority and will not be commenting further until the legal process is fully exhausted and at that time we will publish the reports relating to Upton House.

Update: The registered provider has appealed the Orders of the District Court of 8 December 2010 to the Circuit Court. As the matter is still before the Courts, the Authority will not be making any further comment until all legal proceedings have concluded.
