Pursuant to Sections 59 and 60 of the Health Act 2007, an Ex Parte Interim Order was made by the District Court, Richmond Courts, North Brunswick Street, Dublin 7 on 3 June 2011 cancelling the registration of Rostrevor House Nursing Home as a designated centre under Part 8 of the Health Act 2007, with effect from 5.00pm on 3 June 2011.In accordance with Section 64 of the Health Act 2007, the Health Service Executive was directed to take charge of Rostrevor House Nursing Home from such time and to make alternative arrangements for the residents of Rostrevor House Nursing Home as soon as practicable.This matter then came before the District Court, Richmond Courts, North Brunswick Street, Dublin 7 on 22 June 2011 for the final determination of the matters dealt with in the Ex Parte Interim Order of 3 June 2011.It was ordered by the Judge Blake that:1.       The registration of Therese Lipsett and Kitelm Limited as the registered providers of Rostrevor Nursing Home, 66 Orwell Road, Rathgar, Dublin 6 as a designated centre under Part 8 of the Health Act 2007 be confirmed as being cancelled and that the Ex Parte Interim Order be confirmed and made permanent in that regard, pursuant to Section 61(3) of the Health Act 2007.2.       The Chief Inspector of Social Services of the Health Information and Quality Authority be given liberty to notify the public at large of the making of this permanent Order, to include publication on its website.3.       Those parts of the Ex Parte Interim Order of 3 June 2011 that referred to the Health Service Executive be regarded as vacated.
